Terms of Service

A few things you should know up front:

  • You can use infographicAI to turn your content into infographics. We don't claim ownership of what you create.
  • You're responsible for what you paste in. Don't paste content you don't have the right to use.
  • Free-tier infographics carry a "generated by infographicAI" watermark. Paid-tier downloads don't.
  • Once credits are used, they're gone — but you can cancel your subscription anytime to stop future charges.

1. Who We Are and What This Is

infographicAI ("the Service") is built and operated by XD and bindy, a two-person independent project. In these Terms, "we", "us", and "our" means the makers of infographicAI. "You" and "your" means the person using the Service.

By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

2. The Service

infographicAI is an AI-powered tool that generates infographics from text or URL inputs. The generated infographic is delivered to you in the browser, can be refined through follow-up instructions, and can be downloaded according to your account tier.

The Service relies on Google's Gemini API to generate output. We do not host or train our own AI models.

3. Your Account

You need an account to use the Service. When you create an account, you agree to:

  • Provide a real, working email address
  • Keep your sign-in method secure — whether you use the email magic link or your Google account, you're responsible for activity under your account
  • Not create multiple accounts to abuse the free credit allowance

We may suspend or close accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, violent, sexual, hateful, or designed to harass another person
  • Infringe on copyright, trademarks, or other intellectual property of third parties
  • Generate misinformation, fake news, or content designed to mislead
  • Reverse-engineer the Service, scrape it, or attempt to bypass usage limits
  • Resell or sublicense access to the Service

We monitor for abuse and reserve the right to suspend or terminate accounts that violate these rules. Violations may also be reported to our payment provider Creem, who may take additional action under their merchant policies.

5. Content and Ownership

This section is the most important one for creators, so we've broken it down clearly.

5.1 Your Inputs

You retain all rights to the text, URLs, and materials you paste into the Service ("Your Content"). By using the Service, you grant us a limited license to process Your Content solely for the purpose of generating, storing, refining, and delivering your infographics to you. We do not use Your Content to train AI models, sell it, or share it with anyone except the third-party services described in our Privacy Policy.

5.2 Your Responsibility for Your Inputs

You are solely responsible for ensuring you have the right to use any content you paste into the Service. This includes:

  • Your own original writing
  • Content from URLs you submit (where you must have the right to use, summarize, or visualize the underlying content)
  • Any copyrighted, trademarked, or proprietary material

If a third party claims that Your Content (or an infographic you generated from it) infringes their rights, you — not infographicAI — are responsible for resolving the claim. You agree to indemnify and hold us harmless against any losses, damages, or costs arising from your use of the Service in violation of these Terms or applicable law.

5.3 Generated Infographics

We do not claim ownership of the infographics generated for you. You are free to use, share, modify, and distribute them, subject to the watermark requirements below and your responsibility under Section 5.2.

We make no representation or warranty about the copyright status of AI-generated content. Copyright law for AI-generated works is unsettled in many jurisdictions, and a fully AI-generated work may not qualify for copyright protection in some countries. If you intend to register copyright on a work that includes AI-generated elements, you should consult a lawyer.

5.4 Watermark and AI Disclosure

Infographics generated on the free tier carry a visible watermark in the bottom-right corner reading "generated by infographicAI". The watermark must remain on free-tier outputs and may not be removed, cropped, or obscured.

Paid-tier downloads do not include this watermark. Paid users are responsible for adding their own AI-generation disclosures where required by applicable law — for example, the EU AI Act, China's generative AI regulations, or other jurisdictional requirements. We recommend reviewing the laws of your jurisdiction before publishing AI-generated content.

5.5 Public Sharing

You may choose to share an infographic publicly via a generated link. While the link is active, anyone with the URL can view the infographic. When you cancel sharing, the public URL is deactivated immediately. However, anyone who saved or screenshotted the infographic before cancellation may still have a copy — this is outside our control.

6. Credits and Subscriptions

The Service operates on a credit system. Generating an infographic costs 10 credits. Refining an existing infographic costs 1 credit per edit. Failed generations do not consume credits.

Important caveat about URL inputs: If you submit a URL whose content cannot be accessed (for example, the page blocks crawlers or requires authentication), the Service may still produce an infographic based on the limited information available — for example, error messages or robots.txt content. From the Service's perspective, this is a successful generation and the credits will be consumed. We recommend you preview accessible content before submitting URLs. We will not refund credits in these cases, but we will work to clearly communicate when this happens (see Help Center for tips).

Subscriptions are billed monthly or yearly through our payment provider Creem. You can cancel your subscription at any time via your account settings or the Creem customer portal. After cancellation, you retain access for the remainder of your current billing cycle and will not be charged again.

6.1 Refund Policy

All sales are final. Credits are non-refundable once used. Subscriptions can be canceled at any time and will not be charged for future billing cycles. We may, at our discretion, issue refunds in cases where required by applicable law.

6.2 EU Right of Withdrawal — Express Waiver

If you are a consumer residing in the European Union, EU law normally grants you a 14-day right of withdrawal for distance contracts. However, when you purchase credits or a subscription on the Service, you are asked to expressly consent to the immediate commencement of the digital service. By checking the consent box at checkout, you acknowledge that the service begins immediately upon purchase and that you waive your 14-day right of withdrawal once the service has begun, to the extent permitted by EU law.

If you do not consent to this immediate commencement, do not complete the purchase.

7. Privacy

How we handle your data is described in our Privacy Policy. By using the Service, you agree to the practices described there.

8. Service Availability

We provide the Service "as is" and "as available", without uptime guarantees. We are a small independent project and may experience downtime, bugs, or temporary outages. We will do our best to maintain reliable service, but cannot promise uninterrupted operation.

We may also change, suspend, or discontinue any feature of the Service at any time. If we discontinue the Service entirely, we will notify registered users by email and provide a reasonable window for you to export your generated infographics.

9. Termination

You may stop using the Service and delete your account at any time through your account settings. Upon account deletion, your data is handled as described in our Privacy Policy.

We may suspend or terminate your account at any time for the following reasons:

  • Violation of Section 4 (Acceptable Use)
  • Fraudulent activity, abuse of free credits, or chargebacks
  • Any use of the Service that exposes us to legal liability

In cases of severe violation, we may terminate accounts immediately without prior notice. In other cases, we will attempt to notify you and give you a reasonable opportunity to address the issue.

10. Disclaimers and Limitation of Liability

The Service is provided on an "as is" basis. We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • AI-generated infographics will be accurate, complete, or fit for any particular purpose

AI generation can produce unexpected, inaccurate, or low-quality results. You are responsible for reviewing all generated content before using it publicly or commercially.

To the maximum extent permitted by law, our total liability to you for any claim arising from the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages — including lost profits, lost data, or business interruption.

Some jurisdictions do not allow these limitations, in which case the above applies only to the extent permitted by local law.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last updated" date at the top
  • Notify registered users by email for significant changes

Your continued use of the Service after changes take effect means you accept the updated Terms. If you don't agree with the changes, you can stop using the Service and delete your account.

12. Disputes

This Service is operated as an independent project. Any disputes will be resolved through good-faith communication via support@infographicai.xyz first. We're a small team and we'd much rather solve problems with you directly than escalate them.
